Welcome to NexuSelf! These Terms and Conditions ("Terms") govern your use of our website and mobile application ("Service"), operated by NexuSelf ("Company," "We," "Us," or "Our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use NexuSelf. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.

If you are a parent or guardian allowing a minor to use NexuSelf, you are responsible for their use of the Service and agree to these Terms on their behalf.

2. Definitions

  • Account: A user profile registered with NexuSelf.
  • Service: The NexuSelf website and mobile application, including all features and content.
  • User: Any individual who accesses or uses the Service.
  • Subscription: Paid access to premium features within the Service.
  • Free Trial: A promotional period during which you can access premium features at no charge.
  • Raha: NexuSelf's AI-powered wellness coach, powered by Google's Gemini API and ElevenLabs voice synthesis technology.

3. Account Registration

To access certain features of NexuSelf, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

Important: Please also review our Privacy Policy for information about how we handle your payment and subscription data.

We offer the following subscription plans:

  • Monthly Plan: ₹999/month
  • Yearly Plan: ₹5999/year

Prices shown are in Indian Rupees (INR) and may vary by region. Actual pricing in your local currency will be displayed at checkout.

Each subscription plan provides full access to all premium features of the NexuSelf app.

Apple App Store Subscriptions

For subscriptions purchased through the Apple App Store:

  • Payment will be charged to your iTunes Account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified
  • Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable
  • NexuSelf does not have access to your payment information - all payments are processed securely by Apple

Google Play Store Subscriptions

For subscriptions purchased through the Google Play Store:

  • Payment will be charged to your Google Play Account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Subscriptions may be managed by the user and auto-renewal may be turned off through Google Play account settings
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription
  • NexuSelf does not have access to your payment information - all payments are processed securely by Google

Managing Your Subscription

For Apple App Store subscriptions:

  • Open the Settings app on your iOS device
  • Tap your name at the top
  • Tap Subscriptions
  • Select NexuSelf
  • Tap Cancel Subscription

For Google Play Store subscriptions:

  • Open the Google Play Store app on your Android device
  • Tap Menu → Subscriptions
  • Select NexuSelf
  • Tap Cancel Subscription

Cancellation will take effect at the end of the current billing period. You will retain access to premium features until that time.

Free Trial

If we offer a free trial period:

  • Trial periods are 14 days long
  • No payment information or credit/debit card required to start
  • You will not be charged during the trial period
  • You will receive a notification before your trial converts to a paid subscription
  • Your subscription will automatically convert to a paid subscription at the end of the trial period unless canceled prior to the trial expiration
  • You may only use one free trial per account
  • Free trials are subject to eligibility requirements determined by the platform (Apple or Google)

Refund Policy

For Apple App Store Purchases:

All refund requests must be processed directly through Apple. We do not have the ability to issue refunds for App Store purchases.

To request a refund from Apple:

  • Visit https://reportaproblem.apple.com
  • Sign in with your Apple ID
  • Find the subscription charge
  • Select "Report a Problem"
  • Follow Apple's refund request process

Apple's refund policy applies to all App Store purchases. Refund approval is at Apple's sole discretion.

For Google Play Store Purchases:

All refund requests must be processed directly through Google Play. We do not have the ability to issue refunds for Play Store purchases.

To request a refund from Google Play:

Google's refund policy applies to all Play Store purchases. Refund approval is at Google's sole discretion.

For Direct Website Purchases:

For direct purchases through our website (if applicable), refunds may be issued at our discretion within 7 days of purchase for accidental charges, technical issues, or unauthorized charges subject to verification. Contact us at Contact Support for assistance.

Payment Process

Your payment information is securely processed through authorized payment gateways that comply with industry standards (PCI-DSS).

For app store purchases (Apple or Google), NexuSelf does not have access to your payment card information. All payment processing is handled by the respective platform.

If a payment fails, we will attempt to process the payment again within 7 days. If payment continues to fail after multiple attempts, your subscription will be automatically canceled, and access to premium features will be revoked.

Price Changes

We reserve the right to change subscription prices at any time. Any price changes will be communicated to you in advance via email or app notification. Price changes will take effect at your next billing cycle after the announcement.

For existing subscribers, price changes will not affect your current subscription period. You will be charged the new price at your next renewal date.

Taxes

Subscription fees may be subject to applicable taxes based on your location. If there is a change in tax rates or applicability, your subscription charges may be adjusted accordingly.

Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of our subscription services with or without notice. If we discontinue a subscription plan entirely, we will provide a prorated refund for any unused portion of your subscription.

5. Intellectual Property

Ownership

All content, features, and functionality within the NexuSelf app, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and code, are owned by NexuSelf or our licensors and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the NexuSelf app and its content solely for your personal, non-commercial use in accordance with these Terms and Conditions. This license does not include any resale or commercial use of the app or its contents.

Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the NexuSelf app
  • Use any content for commercial purposes without our express written consent
  • Remove any copyright, trademark, or other proprietary notices from any content
  • Scrape, data-mine, or use automated means to collect data from the app
  • Reverse engineer, decompile, or disassemble any portion of the app

Trademarks

The NexuSelf name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NexuSelf or its affiliates or licensors. You may not use such marks without our prior written permission.

User Content

You retain ownership of any content you submit, post, or display on or through the NexuSelf app. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and promoting the app.

6. User Conduct

You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
  • Use the Service for any purpose that is unlawful or prohibited by these Terms
  • Share your account credentials with others or create multiple accounts

7. Health and Fitness Disclaimer

Not Medical Advice

NexuSelf provides fitness tracking, workout suggestions, and nutrition guidance for informational and educational purposes only. The content and features available through our app do not constitute medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before beginning any diet or exercise program or if you have any questions or concerns about your health.

Sources of Health Information

All health and fitness recommendations in NexuSelf are based on information from the following authoritative sources:

  • BMI Calculations: World Health Organization (WHO) obesity standards and health guidelines
  • Calorie Recommendations: USDA Dietary Guidelines for Americans and Mifflin-St Jeor Equation (published in American Journal of Clinical Nutrition)
  • Macronutrient Targets: Institute of Medicine - Dietary Reference Intakes for protein, carbohydrates, and fats
  • Water Intake: National Academies of Sciences, Engineering, and Medicine - Dietary Reference Intakes for water and electrolytes
  • Weight Loss Guidelines: Centers for Disease Control and Prevention (CDC) healthy weight loss recommendations

Raha is an artificial intelligence wellness coach powered by third-party AI technology (Google Gemini API). Raha's responses are generated automatically and do not constitute medical advice, diagnosis, or treatment. Raha is not a licensed physician, dietitian, therapist, or healthcare professional of any kind. NexuSelf is not liable for any decisions you make based on Raha's suggestions. You must not use Raha as a substitute for professional medical care. If you have a medical concern, consult a qualified healthcare provider.

By using Raha, you explicitly consent to your personal health data being transmitted to Google (Gemini API) for response generation and to ElevenLabs for voice synthesis, as described in our Privacy Policy.

These sources are accessible within the app under Settings → Health Information Sources, where you can find detailed citations and links to the original materials.

Fitness Recommendations

Our workout suggestions and fitness recommendations:

  • Are generated based on general fitness principles from established guidelines (WHO, CDC, ACSM) and the information you provide
  • Are not tailored to account for specific medical conditions unless explicitly stated
  • Should be followed at your own discretion and comfort level
  • May not be suitable for everyone
  • Are based on advanced technology that interprets standard fitness guidelines

Calorie and Nutrition Tracking

The calorie tracking and nutritional information provided by NexuSelf:

  • Is based on generally available nutritional databases (USDA, IFCT) and established calculations (Mifflin-St Jeor, Harris-Benedict)
  • May not be completely accurate for all foods, especially regional or homemade items
  • Should be considered estimates rather than precise measurements
  • Is not intended to diagnose or treat any medical condition

Hydration Tracking

Our hydration recommendations:

  • Are general guidelines based on standards from the National Academies of Sciences (approximately 2.7L for women, 3.7L for men)
  • Do not account for specific medical conditions that may affect hydration needs
  • Should be adjusted based on your activity level, environment, and health status

Assumption of Risk

By using NexuSelf's fitness features, you acknowledge and agree that:

  • Physical exercise involves inherent risks and hazards
  • You are voluntarily participating in these activities
  • You assume all risks associated with using fitness information from our app
  • You are responsible for exercising within your limits and stopping if you experience pain or discomfort
  • You should consult a healthcare provider before starting any new fitness or nutrition program

Results and Outcomes

NexuSelf does not guarantee specific fitness results or outcomes. Individual results will vary based on starting fitness level, consistency of use, adherence to suggested programs, individual biological factors, diet and other lifestyle factors outside our app's control, and pre-existing medical conditions.

9. Termination

Termination by NexuSelf

We reserve the right to suspend or terminate your access to NexuSelf, without prior notice or liability, under the following circumstances:

  • Violation of these Terms of Service
  • Engaging in fraudulent, illegal, or abusive activities
  • Failure to pay subscription fees after multiple attempts
  • Using the app in a manner that places excessive load on our infrastructure
  • Creating multiple accounts for abusive purposes
  • Attempting to access restricted areas of the app
  • Any other use that we reasonably believe is inconsistent with the intended purpose of NexuSelf

Termination by User

You may terminate your account at any time by:

  • Using the account deletion option within the app settings (Settings → Delete My Account)
  • Contacting our customer support team at Contact Support

Effects of Termination

Upon termination of your account:

  • Your access to all premium features will cease immediately
  • You will no longer have access to your account data and content
  • We may retain certain information as required by law or for legitimate business purposes (such as financial records)
  • We will not refund any remaining portion of your current subscription period unless required by law or the platform's refund policy
  • Any outstanding payments will remain due and payable

Data Retention After Termination

After account termination:

  • We will retain your personal data for a period of 45 days before permanent deletion
  • During this period, you may request reinstatement of your account by contacting customer support
  • After this retention period, your data will be permanently deleted and cannot be recovered
  • Financial records may be retained longer as required by law

Survival

The following sections of these Terms will survive termination: Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXUSELF AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NEXUSELF DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXUSELF, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
  • DAMAGES RELATING TO ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • DAMAGES RELATING TO FAILURES OF TELECOMMUNICATIONS, THE INTERNET, ELECTRONIC COMMUNICATIONS, CORRUPTION, SECURITY, LOSS OR THEFT OF DATA, VIRUSES, SPYWARE, LOSS OF BUSINESS, REVENUE, PROFITS OR INVESTMENT, OR USE OF SOFTWARE OR HARDWARE THAT DOES NOT MEET SYSTEM REQUIREMENTS;
  • DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE;
  • RESULTING FROM YOUR USE OF NEXUSELF, ANY CONTENT POSTED ON THE SERVICE, OR ANY OTHER MATERIALS OBTAINED THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NEXUSELF HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Cap on Liability

IN THE EVENT THAT LIABILITY CAN BE IMPOSED ON NEXUSELF DESPITE THE FOREGOING LIMITATIONS, IN NO EVENT WILL NEXUSELF'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO NEXUSELF FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ₹1,000.

12. Indemnification

You agree to indemnify, defend, and hold harmless NexuSelf, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or share through the Service

13. Dispute Resolution

Informal Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting us at Contact Support. We will attempt to resolve the dispute within 30 days.

Arbitration

If a dispute cannot be resolved informally, you and NexuSelf agree to resolve any disputes through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996, rather than in courts of general jurisdiction. Class Action Waiver
